ВИХІД ЗІ СТАМБУЛЬСЬКОЇ КОНВЕНЦІЇ В КОНТЕКСТІ ЄВРОІНТЕГРАЦІЙНИХ ПРАГНЕНЬ ТУРЕЦЬКОЇ РЕСПУБЛІКИ

Анотація

Конвенція Ради Європи про запобігання насильству стосовно жінок і домашньому насильству та боротьбу із цими явищами, відкрита для підписання у 2011 році у м. Стамбул, Туреччина, вважається найбільш всеосяжною міжнародною угодою у сфері недопущення, кримінального переслідування та ліквідації насильства стосовно жінок і домашнього насильства. Станом на вересень 2022 року підписантами Конвенції є 44 держави-члени РЄ, у тому числі всі країни Європейського Союзу, а також, власне, ЄС як міжнародна організація. Факт офіційного підписання Конвенції з боку ЄС в цілому у 2017 році засвідчив акцептуалізацію Брюсселем її ролі як авторитетного міжнародно-правового інструменту, який встановлює загальноєвропейські норми у визначеній сфері. Із неофіційної назви міжнародного договору – Стамбульська конвенція – природньо випливає ступінь залученості Туреччини в питання його інструменталізації. Так, Турецька Республіка стала першою країною, яка підписала Конвенцію у 2011 році згідно із одноголосним рішенням парламенту, а вже у 2012 році надала згоду на її обов’язковість. Ухвалене у 2021 році рішення президента Р. Т. Ердогана про денонсацію міжнародної угоди, яка носить ім’я найбільшого міста Туреччини, викликало подив та занепокоєння з боку міжнародного політичного та правозахисного співтовариства. Не став виключенням і Європейський Союз, в якому крок турецького уряду був розцінений як негативний сигнал в контексті прихильності держави своїм зобов’язанням щодо забезпечення прав жінок і дівчат, а також гарантування основних прав людини, демократії та верховенства права в цілому, враховуючи перебування Туреччини у статусі країни-кандидата на членство в ЄС. З іншого боку, так звана Стамбульська конвенція дотепер не пройшла процедуру ратифікації в окремих країнах ЄС, а також в рамках Європейського Союзу per se.  Про волятильність міжнародно-правових позицій Конвенції також свідчить практика надання їй статусу частини національного законодавства більшістю країн-учасниць із рядом застережень. У даній статті розкривається наступне питання: чи можна розглядати вихід Туреччини зі Стамбульської конвенції як демонстративний політичний меседж з боку офіційної Анкари, який може стати на заваді реалізації євроінтеграційних прагнень країни?
